Is the first picture that of a Sharp-shinned or Cooper's? The unequal tail feathers got me baffled. For comparison, the juvenile Cooper's in picture 2 shows much greater variation of tail feather lengths.

cooper's i think...blocky head, small eye compared to head.  Tail feathers in sitting birds is usually pretty hard to judge IMO.
