he was far-ish. took 3 shoots. first 2 were of his butt. he was eating something off the tree

Very nice picture.

I would say that it's a Warbling Vireo. The eye-stripe doesn't look dark enough and the throat not yellow enough for Philadelphia, but I'm not completely sure.
