Merlin maybe?

One of two on Etobicoke street. Looks different from kestrel but smaller than sharp shinned hawk.

I've never seen a Merlin up close and have never had the opportunity to photograph one
so I'm probably not the best judge. I know it's not a duck.
The breast streaks and light-coloured eye-brow does make me think of Merlin.
Agreed that it is certainly not a kestrel.
Hopefully I'll see one up close some day.
