RFI Bird of prey

Soptted this bird in the yard two houses away. 2 photos, first shot sitting, 2nd shot in flight (not so good). Which bird of prey is it?

Thanks for the confirmation. Looking through my Sibley's guide it looked similar to two birds in the section and the Merlin was one of them. Again thanks for the identification.
