What kind of bird is this?

I was dog sitting at a client's in the Guild today and had my camera since migration is happening and she has a nice little wooded area next door.  This bird was in her yard, the shots are a bit blurry but I'm hoping someone can figure it out.

This photo was shot at a difficult angle for identifying birds, more-so if you're using a guide.  The slightly forked tail and short and sharp finch-like bill combined with the visible yellow, black and white on the body indicate American Goldfinch.  Females would be a little buffier and not show as much yellow.

Thanks Iain, it was not cooperating with me!  I was hoping it would drop down 15 feet or so but it took off and this was as good as I could get.
